1.     Support. Legendary support time applies to all customer needs, which will count towards the Customer’s block of contract hours. Minimum support time will be applied in half hour increments.

1.1.   Example 1. If Customer requested assistance with a physical inventory that has little technical specific requirements and Legendary was to provide assistance, this would still count towards hours worked at a minimum of the tier 1 hourly rate.

1.2.   Example 2. If Customer requested assistance harvesting a part from a system because the Legendary representative had a technical skillset allowing them to assist the Customer, this activity would still count towards hours worked at the rate the Legendary employee was planned to work.

1.3.   Example 3. If Customer requested assistance in a strategy meeting or with an advanced financial analysis, the activity would count the hours worked at the rate corresponding to the topic of meeting.

2.     Design and Development. Legendary has a unique Design perspective that changes and iterates with our Customer’s ever-changing design priorities. We use combinations of waterfall, AGILE, RAPID, and Guerrilla design and development methodologies. This approach requires a very clear understanding from the Customer that although this can provide maximum production launch speed, it also lends to requiring the Customer to provide clear rules on project ownership and governance. We recommend to all Customers focusing on change management, including implementing best practice tools, to ensure clarity of priority and direction for total project success and satisfaction. It is not Legendary’s responsibility to determine who Customer’s leadership or project owners are. If changes are communicated to Legendary and project direction is changed by the Customer, it is the Customer’s responsibility to assist with clarifying confusion within its own organization as to approvals and direction for Legendary team members to ensure mutual success.

3.     Consulting Services.  Legendary support includes many levels of business support and does not only provide traditional support for software services. All of these activities will count against time in the support agreement including conference calls, time to prepare for meetings, presentations, matching records, data loads, defining customer architecture and any other activities related to customer. Any materials requested and offered from Legendary in relation to consulting services may contain forward-looking statements, particularly as related to, among other things, the business plans of the Customer, statements relating to goals, plans and projections regarding the Customer’s financial position and business strategy.
